Terms of Use — Flatty

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Flatty mobile application (the "App"), operated by Kadilo Inc. ("we", "us", or "our").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.

You must be at least 16 years old to use the App.

2. About the App

Flatty is a rental apartment aggregator that collects and displays property listings from publicly available sources in Belarus and Poland. The App is provided on a freemium basis — core features are free, and a Premium subscription is available for an enhanced experience.

Important: Flatty aggregates listings from third-party sources. We do not verify the accuracy, completeness, or legality of individual listings. Always verify listing details directly with the landlord or agency before making any decisions.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, strictly in accordance with these Terms.

You must not:

4. User Responsibilities

You agree to use the App only for lawful purposes and in a manner that does not:

You are responsible for ensuring that your device meets the minimum technical requirements for the App and for maintaining the security of your device.

We recommend against jailbreaking (iOS) or rooting (Android) your device. Doing so may compromise your device's security features and cause the App to malfunction or become unavailable.

6. Premium Subscription

6.1 What's included

The Premium subscription removes advertisements and may unlock additional features as described in the App at the time of purchase. Features included in Premium may change over time; we will notify users of significant changes.

6.2 Pricing and billing

Subscription prices are displayed in the App before purchase and are charged through your Apple App Store or Google Play account. Prices include applicable taxes where required by law.

6.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.

6.4 How to cancel

To cancel your subscription:

Deleting the App does not cancel your subscription. Cancellation takes effect at the end of the current billing period; you retain access to Premium until that date.

6.5 Refunds

All purchases are processed by Apple or Google, and refunds are subject to their respective refund policies:

6.6 EU / EEA consumers — right of withdrawal

If you are a consumer located in the European Economic Area (EEA), including Poland, you have the right to withdraw from a digital content purchase within 14 days of the transaction, provided that the delivery of the digital content has not yet begun with your prior express consent.

By starting to use Premium features immediately after purchase, you expressly consent to the immediate delivery of the digital content and acknowledge that you thereby lose your right of withdrawal. This does not affect your statutory rights under applicable consumer protection law.

7. Advertisements

Free users may see advertisements served by Google AdMob. EEA users will be asked for consent before personalised ads are shown. You may opt out of personalised ads at any time through the App's privacy settings.

Premium subscribers do not see third-party advertisements.

8. Internet Connectivity

Some features of the App require an active internet connection. We are not responsible for the App not working at full functionality if you do not have access to Wi-Fi or if you have exhausted your mobile data allowance.

If you use the App outside of a Wi-Fi area, your mobile carrier's terms apply, including any data roaming charges. By using the App, you accept responsibility for any such charges.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Listing information in the App is aggregated from third-party sources and may be inaccurate, incomplete, or out of date. We accept no liability for any loss or damage arising from reliance on listing information displayed in the App.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Kadilo Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.

EU / EEA consumers: Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable consumer protection law. Your statutory rights are not affected.

11. Changes to the App and These Terms

We may update the App or these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Where required by law, we will provide more prominent notice (e.g., in-app notification).

Continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the App.

We may also discontinue the App or any feature at any time. Where reasonably practicable, we will provide advance notice of discontinuation.

12. Termination

We may suspend or terminate your access to the App if you breach these Terms, without prior notice. Upon termination, all licences granted to you under these Terms immediately cease.

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App does not cancel any active subscription — see Section 6.4.

13. Governing Law and Dispute Resolution

These Terms are governed by applicable law. If you are a consumer in the EEA, you benefit from the mandatory consumer protection provisions of the law of your country of residence, which cannot be derogated from by agreement.
